Introduction
Welcome to the Nairobi School of Forex (NSFX), a subsidiary of the Africa Institute of Financial Markets and Trading (AIFMT). We offer specialized courses in financial markets trading and personal finance management, including the NSFX Traders Course, NSFX Investors Course, NSFX IB Course, and AIFMT Personal Finance Course. These Terms and Conditions govern the provision and use of our services.
Acceptance of Terms
By enrolling in any of our courses, you acknowledge and agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and AIFMT/NSFX. If you do not agree with any part of these terms, you must not proceed with enrollment.
Description of Services
NSFX and AIFMT offer comprehensive courses designed for varying levels of expertise and involvement in financial markets:
1. NSFX Traders Course: Designed for individuals looking to become proficient in trading strategies, market analysis, and risk management.
2. NSFX Investors Course: Geared towards long-term investors focusing on passive investment in the Forex markets through automated Forex trading.
3. NSFX IB Course: Designed for those interested in becoming introducing brokers, focusing on networking, client management, and regulatory compliance.
4. AIFMT Personal Finance Course: Offers insights into personal financial management, budgeting, saving, and investment principles for non-traders.
Each course includes a mix of online, in-person, and LMS-based learning modules.
Eligibility and Enrollment
To be eligible for our courses, you must meet specific criteria, which may vary by course and include minimum age, educational background, and prior knowledge in related fields. Enrollment is subject to completing the application process and acceptance by NSFX/AIFMT. Detailed enrollment procedures, including any prerequisites, will be provided at the point of inquiry or application.
Fees and Payment Terms
Course fees are structured based on the specific course, mode of delivery, and any additional resources provided. Full payment details, including any installment plans, discounts, and refund policies, will be disclosed at the time of enrollment. Failure to meet payment obligations may result in suspension or termination of services without a refund. It’s important to note that refunds are not available once classes have commenced.
User Conduct and Obligations
Participants are expected to maintain a high standard of integrity and professionalism. This includes adhering to academic honesty, respecting copyright laws, and engaging in respectful communication. Harassment, discrimination, or any form of unethical behavior will not be tolerated and may result in immediate dismissal from the course.
Intellectual Property Rights
All course materials, including lectures, presentations, and resources, are the exclusive property of NSFX and AIFMT. While participants are granted access for personal educational use, they must not reproduce, distribute, or use the content for commercial purposes without explicit permission.
Media Consent and Usage Rights
NSFX reserves the right to use any footage, images, testimonials, and other forms of media captured during classes, events, or testimonials, both physical and online, for promotional and marketing purposes. This may include, but is not limited to, use in brochures, websites, social media, and other marketing channels, without any limitation or obligation to the participants. By participating in NSFX courses and events, participants consent to the use of such media by NSFX to showcase and promote our services.
Non-Compete and Non-Solicitation
Participants agree not to engage in or establish any business or professional activity that competes directly with NSFX, nor to solicit students, staff, partners, or other stakeholders of NSFX for competing purposes, during their engagement with NSFX and for a period of two years following the conclusion of their participation in any NSFX or AIFMT courses or events. This provision is designed to protect the proprietary information, trade secrets, and business interests of NSFX and AIFMT.
Privacy Policy
NSFX is committed to protecting the privacy of its participants. Personal information collected during enrollment and course participation will be used solely for educational and communication purposes, in compliance with applicable data protection laws.
Limitation of Liability
NSFX and AIFMT will not be liable for any direct or indirect losses or damages arising from course participation. This includes, but is not limited to, the application of trading strategies in real-world scenarios. Participants are reminded that trading involves significant risk.
Disclaimer of Warranties
NSFX provides educational services “as is” without any warranties, express or implied, regarding the effectiveness of trading strategies or investment returns. Participants are advised to apply knowledge gained in a cautious and informed manner.
Amendments and Modifications
NSFX reserves the right to amend these Terms and Conditions at any time. Such amendments will be effective upon posting on the NSFX website. Participants will be notified of significant changes through email or course platforms. Continued use of services post-amendment constitutes acceptance of the new terms.
Termination of Services
NSFX may terminate a participant’s access to services for reasons including, but not limited to, breach of these Terms, academic dishonesty, or conduct detrimental to the NSFX community. Termination will be communicated through written notice, outlining the reasons and effective date.
Dispute Resolution and Governing Law
Any disputes arising under these Terms will first be attempted to be resolved through mutual negotiation. Failing which, disputes will be subject to arbitration in accordance with the laws of Kenya. The governing law for these Terms shall be the laws of Kenya.
Force Majeure
NSFX will not be liable for delays or failure in performance resulting from acts beyond its control, including natural disasters, war, terrorism, governmental action, or pandemics. Affected obligations will be suspended until the force majeure event ceases.
Miscellaneous Provisions
These Terms constitute the entire agreement between NSFX and the participant. If any provision is deemed invalid, the remaining provisions will remain in full force. NSFX’s failure to enforce any right shall not be deemed a waiver of such or any other right.
